Terms of Use

These Terms of Use (“Terms”) set out the conditions for using Oshi Charts (https://oshicharts.com; “the Site”). The Site is run by its operator, who writes under the pen name Otohime Summer (“the Operator”).

Article 1 (Scope)

1. These Terms apply to all dealings between the Operator and everyone who views or uses the Site (“Users”) in connection with the use of the Site.

2. Any separate rules or guidelines the Operator publishes on the Site (including the Privacy Policy) form part of these Terms. If they conflict with these Terms, the separate rules prevail.

3. By using the Site, you agree to these Terms. When you post a comment, you agree to them again at that time.

4. If you are a minor, please use the Site with the consent of a parent or guardian.

Article 2 (About the Site)

1. The Site is an unofficial information site that compiles and displays public data (such as AniList) about anime, games and VTubers. It is not affiliated with the rights holders of any title or service.

2. Figures, rankings, broadcast schedules and other information are created and updated automatically from the source data. AI is used to write some of the text.

3. The links under “Where to watch” open each service’s search page. They do not guarantee that a title is available.

Article 3 (Intellectual property)

1. Rights in the Site’s text, design, programs and compiled results belong to the Operator or the respective rights holders.

2. Rights in titles, trademarks, artwork, synopses and similar material belong to their respective owners. Artwork and synopses are loaded directly from AniList, which publishes them.

3. Except for private use and quotation permitted by law, you must not copy, republish, distribute or sell the Site’s content without permission. Linking to the Site is welcome.

4. If a rights holder asks us to remove or correct an image or statement, we will respond in accordance with Article 11.

Article 4 (Comments)

1. On title pages you can post comments without registering. A nickname is optional. Comments are limited to 300 characters and nicknames to 20 characters.

2. Before a comment is published it goes through automatic checks (rule-based checks and a review by AI). Only comments judged to be acceptable are published.

3. Published comments can be seen by anyone. They may be retrieved and stored by search engines and other services.

4. We may limit posting, for example when comments are posted in quick succession.

Article 5 (Prohibited conduct)

When using the Site, you must not do any of the following or post content that does any of the following:

(1) Anything that violates the law or public order and morals.

(2) Defaming, insulting, discriminating against, threatening or harassing any person or group (including fans, creators, voice actors, staff and other commenters).

(3) Posting personal information (real names, addresses, phone numbers, email addresses, social media IDs, etc.), trying to find it, or otherwise violating privacy.

(4) Posting links, advertising, solicitation, content aimed at meeting people, or anything else for commercial, political or religious purposes.

(5) Sexual content, excessively violent or cruel content, or content that encourages self-harm or drug use.

(6) Introducing illegally uploaded works or pirate sites, or infringing copyright, trademark, portrait or other rights (including copying other people’s text, images, lines or lyrics without permission, or quoting excessively).

(7) Spoilers for major plot developments or endings.

(8) Content unrelated to the title, meaningless text, repeated posts, or disruptive behavior.

(9) Impersonating others, spreading false information, or manipulating ratings through organized posting from multiple devices or IDs.

(10) Placing excessive load on the Site, servers or networks, unauthorized access, or mass access or collection of information by automated means such as bots and scrapers.

(11) Posting or doing anything intended to evade or interfere with the automatic checks on comments (AI or bot protection), including writing instructions aimed at the AI.

(12) Anything else the Operator considers inappropriate.

Article 6 (Rights in and responsibility for comments)

1. You keep the copyright in your comments.

2. You grant the Operator a free, non-exclusive licence, without a time limit, to store, display and copy your comment on the Site (including converting it into whatever format is needed for display). The Operator will not go beyond this by turning comments into products or by providing or selling them to third parties (except for outside services necessary to run the Site, such as the AI check). The Operator may, however, analyze comments in aggregate, in a form that does not identify anyone, to run and improve the Site.

3. You agree not to exercise moral rights of authorship against the Operator or its successors.

4. You warrant that your comment is your own work and does not infringe the rights of any third party. If a dispute with a third party arises over a comment, you are to resolve it at your own responsibility and expense.

5. If you cause the Operator damage by breaking these Terms, the Operator may claim compensation.

Article 7 (AI checks, hiding and removal, restricting use)

1. Before a comment is published, it is checked automatically by AI (Claude, by Anthropic). Comments judged to be a problem are not published. A category for the reason may be shown on screen, but we do not explain the criteria or give detailed reasons.

2. The AI’s judgment is not perfect. An inappropriate comment may still appear after the check, or a fine comment may not be published.

3. When the “Report” button on a comment is pressed from three different locations (IP addresses), the comment is hidden automatically.

4. If the Operator judges that a comment breaks these Terms or is inappropriate, the Operator may hide or delete it and may restrict posting (including refusing posts from a particular source), without prior notice or explanation.

5. You can delete your own comment at any time from the browser you posted it with. If you clear your browser data you will no longer be able to, so please contact the address in Article 12 in that case.

Article 8 (Changes, interruption and end of the service)

1. The Operator may change, interrupt or end the Site’s content and the comment feature at any time without prior notice.

2. The Site may also be interrupted in whole or in part for system maintenance, natural disasters, power or network failures, the suspension or change of outside services (such as Cloudflare, AniList and Anthropic), or any other reason the Operator considers necessary.

3. The Operator is not responsible for any damage this causes to Users.

Article 9 (Outside services and links)

1. The Site contains links to outside services and sites, such as AniList and video streaming services. The content, services and terms of those sites are set by their providers, and the Operator is not responsible for them.

2. The Site uses Cloudflare for delivery, the database and bot protection, and the Anthropic API for the automatic check of comments. See the Privacy Policy for how information is handled.

Article 10 (Disclaimer)

1. The Operator does not guarantee the accuracy, completeness, timeliness, usefulness or fitness for a particular purpose of the Site’s content (including figures, rankings, schedules, streaming information and comments). Please check official sources before making any important decision.

2. Comments are the personal opinions of the people who post them, not the views of the Operator. The Operator is not responsible for the content of comments. If a report of infringement is made, however, the Operator will respond in accordance with Article 11.

3. Except where the Operator acts intentionally or with gross negligence, the Operator is not responsible for damage arising from the use of, or inability to use, the Site. Even then, the Operator’s responsibility is limited to ordinary direct damage and does not include lost profits or other damage arising from special circumstances.

4. If any law, such as the Consumer Contract Act, prevents all or part of the preceding paragraphs from taking effect, they do not apply to that extent.

Article 11 (Reporting infringement and our response)

1. If you believe your rights (copyright, reputation, privacy, etc.) are infringed by a comment, an image or other material on the Site, please send the following to the address in Article 12:

(1) Where the material appears (the page URL and, for a comment, its text and the date it was posted).

(2) The right you believe is infringed and the reason.

(3) Your contact details for a reply.

2. When we receive a report, we will review it and, where necessary, promptly take measures such as hiding or deleting the comment or hiding the image. A review may take some time.

3. Except where required by law, we will not disclose the reporter’s contact details to the person who posted or to any third party.

4. If a legitimate request for disclosure is made under the law, we will respond within the scope of the information we hold. Note that our database does not store posters’ names, contact details or IP addresses themselves (see the Privacy Policy).

Article 12 (Contact)

Article 13 (Changes to these Terms)

1. The Operator may change these Terms when it judges this necessary, where the change is in Users’ general interest or is reasonable. The revised Terms take effect when they are published on the Site.

2. For significant changes that are unfavorable to Users, we will give notice on the Site a reasonable period before they take effect.

3. If you use the Site or post a comment after a change, you are deemed to have agreed to the revised Terms.

Article 14 (Severability)

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions stay in effect.

Article 15 (Governing law and jurisdiction)

1. These Terms are governed by and interpreted under the laws of Japan.

2. If a dispute arises concerning the Site or these Terms, the court in Japan that has jurisdiction over the Operator’s location is the exclusive court of first instance by agreement.
